Terms of Service

These Terms of Service govern access to and use of the Marc Jovelle website, online store, content, products, features, and related services (the “Services”). “Marc Jovelle,” “we,” “us,” and “our”, trading as Marc Jovelle. “You” and “your” refer to each visitor, account holder, or customer.
By accessing the Services, creating an account, submitting information, or placing an order, you agree to these Terms and the policies referenced below. If you do not agree, do not use the Services.
1. Eligibility
You must have legal capacity to enter into a binding agreement in your jurisdiction. If you are below the age of legal majority, you may use the Services only with authorization from a parent or legal guardian. The Services must not be used for unlawful, fraudulent, abusive, or unauthorized purposes.
2. Store and Product Information
We make reasonable efforts to present descriptions, images, prices, colors, sizes, materials, availability, and other product details accurately. Display settings, photography, lighting, production tolerances, and product updates may result in minor differences. We may correct errors or incomplete information and may cancel an affected order where reasonably necessary.
3. Products and Availability
Merchandise may be offered in limited quantities. We may add, modify, restrict, replace, or discontinue products without prior notice. We may limit purchases by customer, account, household, payment method, shipping destination, or order when reasonably necessary to protect inventory, prevent abuse, or comply with law.
4. Orders and Acceptance
An automated order confirmation means that the order request was received; it does not by itself constitute final acceptance or guarantee shipment. We may hold, refuse, or cancel an order because of:
- inventory or product unavailability;
- an incorrect price, description, promotion, or technical error;
- payment authorization failure;
- suspected fraud, resale, policy abuse, or unlawful activity;
- incomplete or unverifiable billing, identity, or delivery information; or
- destination, carrier, or legal restrictions.
If we cancel an order after collecting payment, the applicable amount will be returned to the original payment method.
5. Prices, Taxes, and Payment
Prices are shown in the currency selected or displayed by the store. Shipping, tax, customs duty, import charges, and other applicable amounts may be added during checkout. You agree to provide current and accurate payment, billing, contact, and delivery information.
Discounts and promotions may have separate eligibility rules, expiration dates, quantity limits, and exclusions. Unless expressly stated, offers cannot be combined or applied retroactively.
6. Shipping
Processing times, estimated delivery ranges, tracking, address obligations, customs charges, and delivery limitations are described in our Shipping Policy. Estimates are not guaranteed arrival dates.
7. Returns and Refunds
Return eligibility, damaged-item claims, exchanges, cancellations, and refunds are governed by our Return and Refund Policy and mandatory consumer law.
8. Accounts and Security
You are responsible for maintaining the confidentiality of account credentials and for activity conducted through your account. Notify us promptly if you suspect unauthorized access. We may require verification before discussing or changing an account or order.
9. Prohibited Uses
You must not:
- use the Services for fraud, deception, harassment, abuse, or unlawful activity;
- attempt unauthorized access to systems, accounts, checkout, inventory, or data;
- introduce malicious code, automated attacks, or harmful material;
- circumvent technical, security, purchasing, or geographic restrictions;
- scrape, reproduce, resell, or commercially exploit store content without permission;
- submit false reviews, fraudulent claims, or misleading information;
- interfere with another person's use of the Services; or
- infringe intellectual-property, privacy, publicity, or other legal rights.
10. Intellectual Property
Unless otherwise stated, the Services and their original text, branding, graphics, photography, video, icons, layouts, and design elements are owned by or licensed to Marc Jovelle and are protected by applicable laws. No license is granted except the limited right to access the Services for personal, non-commercial shopping purposes. Written permission is required for reproduction, modification, distribution, republication, or commercial use.
11. Reviews and User Content
When you submit a review, image, comment, suggestion, or other material, you represent that you have the right to submit it and that it is accurate, lawful, and non-infringing. To the extent allowed by law, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, display, and use that material for store operation, customer support, product improvement, and marketing.
We may moderate or remove material that is unlawful, abusive, misleading, fraudulent, irrelevant, or inconsistent with these Terms.
12. Third-Party Tools and Links
The Services may depend on or link to payment providers, carriers, analytics services, review platforms, social networks, and other third parties. Their services are subject to their own terms and privacy practices. Except where law provides otherwise, we are not responsible for a third party's availability, content, or conduct.
13. Availability and Changes
We do not guarantee uninterrupted or error-free availability. Maintenance, security events, networks, carriers, or third-party systems may affect the Services. We may change or discontinue a feature where reasonably necessary.
14. Disclaimers
To the fullest extent permitted by law, the Services are made available on an “as available” basis. We do not exclude any product warranty, consumer guarantee, or statutory protection that cannot legally be excluded.
15. Limitation of Liability
To the maximum extent permitted by law, Marc Jovelle and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential loss arising from the Services or products. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law.
16. Indemnification
To the extent permitted by law, you agree to defend and indemnify Marc Jovelle and its officers, employees, contractors, and service providers from claims, losses, and reasonable expenses arising from your unlawful conduct, material breach of these Terms, or violation of another person's rights.
17. Suspension and Termination
We may suspend or terminate access when we reasonably believe that these Terms have been materially breached, fraud or unlawful conduct has occurred, or continued access creates a security, legal, or operational risk. Provisions that logically survive termination will remain effective.
18. Severability and No Waiver
If a provision is held invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Failure to enforce a provision once does not waive the right to enforce it later.
19. Governing Law
These Terms are governed by the laws of, without depriving a consumer of any mandatory protection provided by the law of the consumer's residence.
20. Changes to These Terms
We may update these Terms for operational, legal, security, or regulatory reasons. The current version will be posted here with a revised effective date. Continued use after an update constitutes acceptance to the extent permitted by law.
